These terms govern your use of phitenindia.com, operated by Nihon ("we", "us"), New Delhi, India — the authorised distributor of Phiten Co., Ltd, Japan for India.

1. Using this site

You may browse, register interest and place orders for your own use. You may not reproduce our photography, text or design commercially without written permission. Phiten®, Aqua Titanium and Metax are trademarks of Phiten Co., Ltd, Japan, used here under authorisation.

2. Products and descriptions

We describe products as accurately as we can. Colours may vary slightly on screen. Where a description here conflicts with the packaging supplied by Phiten Japan, the packaging governs.

3. What these products are

Phiten products sold here are general wellness products intended to support relaxation and recovery. They are not medicines and not medical devices. They do not diagnose, treat, cure or prevent any disease or condition, and they are not a substitute for medical, physiotherapy or other professional care. Nothing on this site is medical advice. If you have a condition or injury, are pregnant, or have sensitive or broken skin, speak to a clinician before use.

4. Orders and pricing

Prices are in Indian Rupees and inclusive of applicable taxes unless stated otherwise. Placing an order is an offer to buy; the contract forms when we confirm dispatch. We may decline or cancel an order, with a full refund, where an item is unavailable, where a price or description was published in error, or where we suspect fraud.

5. Delivery, returns and refunds

6. Liability

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability in connection with an order is limited to the amount paid for it, and we are not liable for indirect or consequential loss.

We may update these terms. The version published here when you order is the one that applies to that order.

9. Governing law

Indian law applies, and the courts at New Delhi have exclusive jurisdiction.
